1950- now, vaccines against rubella, mumps, TB, etc, contain thymerosal and mercury and other preservatives. Now the conspiracy lunatics say the vaccines were to kill babies that WWII did not kill.

June 1994, Shoemaker-Levy comet crashed into Jupiter in several pieces. Conspiracy nuts said it was really NASA probes trying to ignite Jupiter.
It was pieces of a comet really. "Levy" was the proof that Jewish conspiracy was involved.

July 1995 Galileo probe was intentionally crashed into Jupiter, because the Shoemeaker-Levy space probes failed to ignite Jupiter. Conspiracy nuts said that the isotope based power generator was really to ignite Jupiter as a second sun, for various purposes. One of which, is to make Earth heat up and scare everyone with global warming.
Galileo was launchedc 5 years before the appearance of the Shoemaker-Levy comet.

Year 2000, Y2K bug - conspiracy nuts and many yeshiva students said that January 1st 2000 all machines are going to go crazy due to refusal to fix the 2000 bug in computers. In reality, no computer malfunctioned, in Machon Meir or in any government.

2001, sept 11. "US government attacked the World Trade Center", in order to justify the war on terrorism, but really to spy on people of the world, and kidnap many people whose remains were never recovered.

2007, 2012, 2013, 2017 Nibiru scare - a planet-monster called Nibiru by Babylonians was going to collide with Earth on either of these years, and US Government was hiding it from the world, on order to capitalize on panic.

2013 (the idea invented for the Hollywood movie) the end of the world according to the Mayan calendar - the world was supposed to end, and the US Government was hiding it from the world. Hollywood made a movie about the event, which reinforced the conspiracy. Mayans and Infowars have been stupid all along.

Remembering the Armenian Holocaust

Today is 24th of April, the Day to Honor the victims of Armenian Holocaust waged by Turkey .
It is important to note that Nazi Germans realized the total lack of world attention to the British concentration camps for Boers in South Africa, and the slaughter of Armenians. The Nazis were convinced that the world will allow them to exterminate Jews and Gypsies, among other ethnicities.

It has reported on the Museum of Ancient Greek Technology, which has two floors of models of early Greek inventions, located in the Ilia region of the Peloponnese Archipelago of Greece, in the town of Katakolo, the port call for cruise ship day trips to Olympia.

How chemical giants and their patents helped Nazi Germany

A new book Hell's Cartel: IG Farben and the Making of Hitler's War Machine by Diarmuid Jeffreys (Metropolitan Books)has been published, incurring the first sentence of the review describing correctly the tone of the book: In February 1941, a top manager of German chemical group IG Farben thought he had found the perfect location for a new synthetic-rubber factory. The site was out of range of Allied bombers, easily reached by rail, and had plenty of water and coal. Most important, there was a ready supply of cheap labor. The site was near a town in occupied Poland called Oswiencim, better known to history as Auschwitz. The author writes at one point about how important IG Farben's role was: "Had IG Farben been even marginally less compliant, Hitler would have struggled to get his war machine moving." IG Farben was a consortium/cartel formed by big German companies Bayer, BASF, Hoechst and with many smaller companies in 1925, which were and still are big patentees in the chemical world. That these companies are such big patentees relates to an interesting lament in the review: "Probably never in history has a major corporation been twisted to such evil ends. Yet what is most disturbing is that, for most of its past, the conglomerate and its predecessor companies embodied many of the qualities we admire in business today. Its managers were inventive and diligent, and its scientists discovered vital medicines, with quite a few earning Nobel prizes." And even more were earning patents. Interestingly, a book based on a PhD thesis: "Divide and Prosper: The Heirs of I.G. Farben Under Allied Authority, 1945-1951", by Raymond G. Stokes (University of California Press, 1988) discusses, among other things, how the Allies temporarily "seized" the patents of the I.G. Farben component companies as part of their post-war control of Germany. If anyone buys/reads the book, I'd appreciate any comments on it, especially in comparison to a controversial book written a few years ago about another well managed, innovative company with many patents whose products were used by the Nazis to evil ends - IBM. That book was titled "IBM and the Holocaust" by Edwin Black. I quote from the Wikipedia entry on "History of IBM": Although IBM actively worked with the Hitler regime from its inception in 1933 to its demise in 1945, IBM has asserted that since their German subsidiary came under temporary receivership by the Nazi authorities from 1941 to 1945, the main company was not responsible for its role in the latter years of the holocaust. Shortly after the war, the company worked aggressively to recover the profits made from the many Hollerith departments in the concentration camps, the printing of millions of punch cards used to keep track of the prisoners, the custom-built punch card systems, and its servicing of the Extermination through labor program. The company also paid its employees special bonuses based on high sales volume to the Nazis and collaborator regimes. As in many corporate cases, when the US entered the war, the Third Reich left in place the original IBM managers who continued their contacts via Geneva, thus company activities continued without interruption. IBM can always be blamed for the "monstrously bad" logic, bad science and worse engineering of Benson, a decision lawyers should be disbarred for citing, the decision being such a travesty of justice, a decision that quotes three paragraphs from a U.S. presidential commission on software dominated and controlled by... IBM, the first and biggest troll ever. Making their stock usually a good buy.

How nanotechnology started really in 17th century, if not earlier

The Corning Museum of Glass is having an exhibit through 4 January 2008 on the legitimate work of alchemists from 1650 to 1750 with regards to glass, a period in which some alchemists transformed themselves and their field into the science of chemistry. The 20 August 2008 issue of the Wall Street Journal, page D9, has a nice review of the art show. A few of the review's paragraphs briefly recount one early success in what is now the field of nanotechnology similar to that of the even earlier success of ancient Mayans making the nano-sized Mayan Blue pigment:
The other contribution from alchemists during this period was ruby-gold glass, which has a distinctive red hue. The problem had long been dissolving the gold down to precise nanoparticles. If the particles were too small, they wouldn't scatter the light among the proper spectrum and the glass would appear clear. Too big, and the glass had a turbid, brownish color. The key breakthrough came in 1659, when alchemist Johann Rudolf Glauber published a paper describing how to make purple of Cassius. Using an ancient formula called aqua regia, a mix of nitric and hydrochloric acid used to dissolve gold, Glauber added a small amount of tin, which reacted with the gold to produce perfectly sized particles. Glassmaker Johann Kunckel used the purple of Cassius formula to make the first ruby-gold vessels in the 1680s. Some glass pieces using this technology are on display in the exhibit. Very valid prior art.

Codex Sinaiticus - an oldest prior art reference goes online

Newswires report that a group of libraries led by the University of Leipzig, over the next year, will be making high resolution images of the Codex Sinaiticus, written in Greek, one of the oldest copies of the New Testament (it is more than 1600 years old). The images will be available at: www.codex-sinaiticus.net As the Bible has been used as a prior art reference, I argue that it is the oldest prior art reference.

The last of the real steam-paddle boats retires

The "Delta Queen", the last operating proper steam-paddle boat in the U.S., is to go retire - sad news for historians of technology and boat lovers. The boat owners are unable to get a Congressional exemption from some of the navigation rules that apply to both river-going and ocean-going ships (the Delta Queen has some inherent structural problems due to its wooden superstructure). The Delta Queen has a modern fire sprinkler system, and has never caught on fire. Since 1904, Congress has been ignorant of developments in boat safety .

A short profile on a little known THC expert

Little do people know that the test for the use of marijuana has been fine-tuned by a humble and unknown professor at the University of Illinois. Roger Adams, 1889-1971, Boston-born Harvard graduate and a Ph. D. recipient, taught chemistry at the University of Illinois. Together with Sir Alexander T, he succeeded in elucidating the exact structure of tetrahydrocannabinol, THC, the active ingredient in marijuana plants. Adams exposed the inaccuracy of the common test for THC administered by the Federal Bureau of Narcotics, due to the test detecting a non-narcotic material.

A history of artistic invention

INVENT - v.t. to originate or create as a product of one's own ingenuity, experimentation or contrivance; to produce or create with the imagination Around 6000 BCE, Mesopotamian artists invent "art pottery". Pottery itself is invented earlier by Neolithic farmers in villages along the Tigris and Euphrates rivers. Around 2500 BCE, Egyptian chemists invent the first "synthetic color pigment", Egyptian blue, a mixture of limestone (calcium oxide), malachite (copper oxide) and quartz (silica), carefully fired to a temperature of 800 to 900 degrees Celsius. Around 1500 BCE, Egyptian craftsmen invent "glass bottles", by attaching metal rods to silica paste cores and repeatedly dipping the cores into molten glass. Around 1200 BCE, the Phoenicians invent "Tyrian purple", an expensive dye made from a Mediterranean snail. Around 610 BCE, scupltors in Greece invent "free-standing human scultpure" known as kouroi for male figures and korai for female figures, which are used as religious votive offerings. Around 570 BCE, musicians in India invent "hollowed string instruments", specifically the vina which consists of two hollow gourds connected by strings and a bamboo reed. Around 450 BCE, Greek artists invent "chiaroscuro", three dimensional painting, by using highlighting and shadowing. In 105, Chinese court official Ts'ai Lun invents "paper". His paper is cheaper to produce than papyrus or parchment. In the mid-600s, Chinese artists in the Tang Dynasty invent "porcelain", a fired mixture of kaolin (a clay) and petuntse (a feldspar). It is not until 1708 that Europeans learn the secret of making porcelain, when the German chemist Friedrich Bottger in Meissen makes porcelain from clay and ground feldspar. In 855, European musicians invent "polyphonic music", music that combines several simultaneous voice parts. In 1022, Murasaki Shikibu (a young noblewoman in Kyoto, Japan) invents the first "(romance) novel", the story Genji the Shining One, with 1200 pages in the English translation. In 1041, the Chinese printer Pi Sheng invents "movable type", for printing, made with clay blocks. 400 years later in Germany, in 1454, Johannes Gutenberg invents metal movable type. Around 1360, Germans invent "stringed keyboard instruments", starting with the clavichord and harpsichord. German wiresmiths do so by pulling wire through steel plates. The keyed monochord, the forerunner of the clavichord, dates back to the 1100s. In 1437, English composer John Dunstable invents "counterpoint" for musical compositions. In 1470, Italian printer Nicolas Jenson invents the "Roman typeface", by adapting Roman script to typography. Today's very popular Times New Roman font is descended from Jenson's. In the 1480s, Leonardo da Vinci invents the technique of "sfumato" where shadows and objects in the distance are blurred to reflect atmospheric distortions, for example, his 1485 painting Virgin of the Rocks. In 1494, Venetian printer Aldus Manutius invents the "textbook", i.e, small printed books, octavo sized (6 by 9 inches), for students. In 1501, Manutius invents the "italic" typeface, a smaller typeface based on cursive script for his new smaller books. In 1578, English writer John Lyly invents "euphuism", in his book, Euphues, the Anatomy of Wit. The writing style of euphuism is characterized by extensive use of simile and illustration, balanced construction, alliteration and antithesis. In the 1610s, Italian artist Artemisia Gentileschi invents "feminist art", painting women who wreak violence against men who have wronged them, for example, her 1614-1620 painting 'Judith Slaying Holofernes'. Her style is motivated by her being raped, and then tortured in a trial to get her to recant, as well as being motivated by the work of Caravaggio. In 1657, Savinien Cyrano de Bergerac invents "science fiction" with his story Les Etats et empires de la lune about a trip to moon. One might also attribute this invention to the Greek satirist Lucian of Samosata, who in the year 125 wrote the story 'The True History' in which he describes a trip to the moon. In 1780, Spanish ballet dancer Sebastian Cerezo invents the "bolero", danced to guitar and castanets. In 1832, German musician and silversmith Theobald Boehm invents the "modern flute", the first to use mechanical levers as keys to allow for the control of multiple tone holes. In 1847, he develops an improved version which becomes the basis of modern flutes. In 1837, the German scientist Friedrich Froebel invents structured educational entertainment for children, i.e., "kindergarten". One student of Froebel's kindergartens was Piet Mondrian, who with Theo van Doesburg, started the De Stijl style of art in 1917. In 1841, the American painter John Rand invents "collapsible metal paint tubes", replacing pig bladders in which paint tended to dry out quickly. Pierre-Auguste Renoir remarked that "without paints in tubes, there would have been no Cezanne, no Monet, no Sisley or Pissarro, nothing of what the journalists were later to call Impressionism". In 1872, the photographers Eadweard Muybridge and Jules-Etienne Marey use multiple cameras to prepare photographs of moving objects, "serial photomontages", the precursors to motion pictures. In 1879, American author Ella Cheeber Thayer invents the idea of "online romance", in her book Wired Love: a romance of dots and dashes, a story about two American telegraph operators who conduct a romance using telegraph messages. In the 1880s, Argentinians invent the "tango", dance and music that is a mix of African, Indian and Spanish rhythms. The first forms of the tango dance are based on the "acting out" of the relationship between prostitutes and pimps. Around 1905, Buddy Bolden and Jelly Roll Morton combine ragtime, the blues, and spirituals to invent what is to become known as "jazz". In 1909, Italian poet Filippo Thommaso Marinetti invents "Futurism", in his manifesto Founding and Manifesto of Futurism, in which he encourages artists to celebrate "a new beauty, the beauty of speed". Futurist painters combined the bright colors of Fauvism with the fractured planes of Cubism to express mechanization, movement and propulsion. In 1920, Marcel Duchamp invents "intellectual property art" in his 1920 'Fresh Widow', a wooden window on which he painted the word "copyright" for an object that typically would be patentable. In 1932, Alexander Calder invents "mobiles", where he suspends sheets of metal painted black, white and primary colors, from wires and rods. His inspiration was seeing the colored rectangles covering the walls of Mondrian's studio. His art forms are named by Marcel DuChamp. In 1949, American painter Dan Robbins invents "paint-by-number kits". Robbins was inspired by Leonardo da Vinci's practice of assigning numbered sections of his paintings to apprentices. In 1966, Spanish author Julio Cortazar invents "hypertext" in his book 'Hopscotch'. His book has 155 chapters, with chapters 1 to 56 meant to be sequentially as in the normal fashion. However, at the end of each of these chapters is the number of an alternative chapter the reader can elect. For example, chapter 2 ends with a link to chapter 116, which itself has a link to chapter 3, giving the reader the choice of reading chapter 116 or not. Cortazar's book is cited by computer programmers creating the first computer-based hypertext systems. Cortazar, in his book, does not indicate if he was aware of Vannevar Bush's 1945 Atlantic Monthly articles on his proposed Memex information system which has an associative-indexing feature, hyperlinks. In 1968, the Plato's Stepchildren episode of the television show Star Trek invents "broadcast interracial sex" when Kirk(white) kisses Uhura (black). This kiss is more controversial than the first broadcast intercultural kiss in the 1950s on the show I Love Lucy. The kiss is less entertaining than a kiss on the cheek a few years later between Archie Bunker and Sammy Davis Jr. In 2000, artist Eduardo Kac invents "transgenic animal art" when he creates the 'GFP Bunny', a transgenic rabbit whose cells are augmented with the Green Flourescent Protein gene, which causes the rabbit to glow under a black light.

Milking business out of abandoned brands

This company deserves a round of applause http://www.riverwestbrands.com/ I remember the advertising slogan: “Fill it to the rim — with Brim!” Those ads haven’t been shown in years, and Brim itself has been off retail shelves since the 1990s. Yet depending on how old you are, there’s a fair chance that there’s some echo of the Brim brand in your brain. That’s no surprise, given that from 1961 to around 1995, General Foods spent tens, if not hundreds, of millions of dollars to get it there. But General Foods disappeared into the conglomerate now known as Altria, which also acquired Kraft, maker of Maxwell House. With much smaller sales than that megabrand, Brim soon disappeared — except, perhaps, for a vague idea of Brim that lingered, and lingers even now, in the minds of millions of consumers. What’s that worth? A small company in Chicago, called River West Brands, figures that it’s definitely worth something, and possibly quite a lot. The firm did its own research a year or so ago and claims that among people over the age of 25, Brim had 92 percent “aided national awareness.” What this means is that if you ask people anywhere in America if they have ever heard of Brim, about 9 out of 10 will say yes. If true, that’s potentially a big deal. Building that level of recognition for a new brand of coffee — or anything else — from scratch would involve an astronomical amount of money, a great deal of time, or both. Marketers like to talk about something called brand “equity,” a combination of familiarity and positive associations that clearly has some sort of value, even if it’s impossible to measure in a convincing empirical way. Exploiting the equity of dead or dying brands — sometimes called ghost brands, orphan brands or zombie brands — is a topic many consumer-products firms, large and small, have wrestled with for years. River West’s approach is interesting for two reasons. One is that for the most part the equity — the idea — is the only thing the company is interested in owning. River West acquires brands when the products themselves are dead, not merely ailing. Aside from Brim, the brands it acquired in the last few years include Underalls, Salon Selectives, Nuprin and the game maker Coleco, among others. “In most cases we’re dealing with a brand that only exists as intellectual property,” says Paul Earle, River West’s founder. “There’s no retail presence, no product, no distribution, no trucks, no plants. Nothing. All that exists is memory. We’re taking consumers’ memories and starting entire businesses.” The other interesting thing is that when Earle talks about consumer memory, he is factoring in something curious: the faultiness of consumer memory. There is opportunity, he says, not just in what we remember but also in what we misremember. River West is a young company, and few of its ideas have been directly tested in the marketplace. The revival of Brim, for instance, has yet to crystallize into a plan with real manufacturing and distribution partners. But River West is starting to bring some familiar names back into the consumer realm. It is thanks to River West that you can buy Nuprin again at CVS. The firm has also played a role in the return of Eagle Snacks to some grocery-store aisles. In late January, Drugstore.com began accepting orders for Salon Selectives, which is also making its way into 10,000 stores, including every Rite Aid in America and grocery chains like Winn-Dixie and Pathmark. And by way of a deal with River West, Phantom, a Canadian hosiery manufacturer, is pushing a new version of Underalls to department-store and boutique clients in the U.S. Whether these brand-reanimation efforts pan out as a successful business strategy or not, they offer an unusual perspective on the relationship between brands and the brain. By and large, examinations of successful branding tend to focus on names like Harley-Davidson, Apple or Converse, which have developed “cult” followings. Such cases are misleading, though, because they are not typical of most of what we buy. A great deal of what happens in the consumer marketplace does not involve brands with zealous loyalists. What determines whether a brand lives or dies (or can even come back to life) is usually a quieter process that has more to do with mental shortcuts and assumptions and memories — and all the imperfections that come along with each of those things. River West’s offices, on the 36th floor of the Chicago Board of Trade Building, are sprinkled with the bric-a-brac of obscure products: a Quisp cereal box, Ipana toothpaste packages, Duz detergent bottles. On a wall of Paul Earle’s office is a framed, five-foot-by-three-foot sheet of uncut “Wacky Packages” stickers — those 1970s trading-card-size brand-parody images that rendered the word Crust in the style of the Crest logo, for example. Earle has a Midwestern everyman quality about him: he’s compact, with a big and friendly let’s-get-along voice and a penchant for deadpan jokes. Only his designer-eyeglass frames deviate from his overall demeanor. Even so, he has set out to make this particular civic mission turn a profit. While he recognizes that a given brand might not be able to survive in the portfolio of a multinational, different sorts of business models might work to sustain it. As surely as the ownership of brands has consolidated through one megamerger after another, the consumer market seems to be moving in the opposite direction, with an individualism-fueled demand for almost unlimited variety. Earle’s theory is that such demand means room for brands like the ones River West owns, and his idea is facing its most significant test to date, by way of the reanimation of Salon Selectives. Helene Curtis began selling this line of shampoos in 1987, and sales shot past the $100 million mark within a year or so. It was, one Wall Street enthusiast claimed at the time, “probably the most successful hair-care launch in the history of the universe.” Heavily advertised, the brand was a pioneer of the sales pitch, now routine, of a “salon” product available for home use. Unilever bought Helene Curtis in 1996, acquiring a new batch of cosmetic, shampoo and deodorant brands that had to be integrated into those the conglomerate already offered. It’s often hard to pin down the exact moment a brand disappears, because a product can linger on retail shelves for quite a while before it’s sold down or otherwise liquidated. But by the early 2000s, Salon Selectives had become a casualty of brand-portfolio consolidation. A few years later, River West acquired what was left of it: intellectual property like the trademarks and the original formulas. River West’s partner in the Salon Selectives effort is called SSB, which has five full-time employees coordinating the efforts of various subcontractors (manufacturers, package-makers) out of River West’s offices. Selective Beauty is run by Gene Zeffren, a former top executive at Helene Curtis with a Ph.D. in chemistry. Earle and Zeffren are partly motivated by the belief that there is a core of Salon Selectives fans out there who miss their product and are eager to buy it again. You would think, then, that the goal would be to give those consumers their old brand back, just as it once was. And sure enough, when I visited Anne West, the chief marketing officer of the new Salon Selectives, there was an array of pink plastic bottle samples in her office, part of an attempt to match the old color as closely as possible. She showed me a video in which a surprising number of randomly confronted Chicagoans, asked if they remembered Salon Selectives, responded by singing the jingle. Then she showed me storyboards for new Salon Selectives ads, which were not much like the original ones at all. She went on to explain that while the bottle color would be the same, its shape would be different. The reintroduced line also includes a number of new products, and the products are now more aggressively marketed as “customizable” (by hair length, thickness, texture, etc.) than they were in the earlier incarnation. Then there’s the apple scent. West said fans of the brand in its heyday frequently cited that signature smell as one of the things they missed most about the shampoos. So the new version will have an apple scent — but even that was being tweaked and “updated.” The bottom line is that Salon Selectives isn’t coming back just as it used to be, but sort of as it used to be. West figures that fans of the brand who are nostalgic for their long-lost product just need to know that it’s back. But the real point now is to attract younger customers who probably never used the stuff. The name “Salon Selectives” might sound familiar to them, so the strategy must balance that familiarity with something that makes the product seem fresh and novel. Later West sent me the new Salon Selectives ads, now running on VH1, Lifetime and other cable networks. The spots do not announce the return of a favorite old brand, or even allude to the fact that Salon Selectives was ever gone. In one, a woman escapes from prison and immediately washes her hair. The cop who confronts her admits that she doesn’t look like an escaped con but (punch line) as if she “just stepped out of a salon.” This is followed by glimpses of the (pink) bottles and a quick “mix and match” pitch and then, at the very last second, a snippet of the familiar old jingle, rerecorded. West calls this snippet a “button,” and it clearly aims to function as the slightest mental nudge: this is something you know about. Among River West’s various projects, this is actually one of the more conservative in testing the boundary between the positive associations of a familiar memory and the attractions of novelty. There’s less room to test that boundary because Salon Selectives hasn’t been “dormant” all that long: At least some fans of the old apple scent are going to have opinions about the “updated” version. Much will depend on specific associations with a product — which is not the same thing as a brand. Brands aren’t quite so tangible, so quantifiable. That’s what’s interesting about them. One of Paul Earle’s professors at Kellogg was John F. Sherry Jr. (now at Notre Dame), who has devoted some study to “retromarketing” and “the revival of brand meaning.” In 2003 he wrote an article (with Stephen Brown of the University of Ulster and Robert V. Kozinets of Kellogg) on the subject for The Journal of Customer Behavior. “Retromarketing is not merely a matter of reviving dormant brands and foisting them on softhearted, dewy-eyed, nostalgia-stricken consumers,” they asserted. “It involves working with consumers to co-create an oasis of authenticity for tired and thirsty travelers through the desert of mass-produced marketing dreck.” I wasn’t entirely sure what that meant, but Sherry turned out to be more straightforward in conversation. “There’s no real reason that a brand needs to die,” he told me, unless it is attached to a product that “functionally doesn’t work.” That is, as long as a given product can change to meet contemporary performance standards, “your success is really dependent on how skillful you are in managing the brand’s story so that it resonates with meaning that consumers like.” The holy grail example of brand reanimation is the Volkswagen Beetle, which a few years ago rose from dormancy and became a hit all over again in an updated form that was both nostalgic and contemporary. The reintroduced Beetle layered “nostalgic reassurance” over modern functionality. “It’s a brand that’s memorable for a lot of different reasons,” Sherry said. “But largely because it evokes this past that never was — that was morally superior or simpler, an era of better craftsmanship. That kind of thing.” Such abstract notions are much on display at the Licensing International Expo, an annual event at which the owners of cultural properties — TV shows, movies, cartoon characters — meet with makers of things and try to negotiate deals granting them a paid license to use the properties to add meaning and market value to whatever things they make. It is a good place to contemplate the business potential of “the brand” in free-floating form, unmoored to any product or company that may have actually created it. A surprising number of the symbols represented at the expo held last summer in New York were simply brand logos. Spam, for instance, had its own booth. IMC Licensing was there on behalf of its clients Oreo, Altoids, Dole and Oscar Mayer. At one point I encountered a person dressed up as a can of Lysol, which is represented by the Licensing Company. Another firm that represents a number of consumer brands is the Beanstalk Group, which staked out a rather large chunk of floor space at the expo, complete with a coffee bar and about 20 tables. Owned by Omnicom Group, Beanstalk is the licensing firm for a wide range of cultural properties, from Harley-Davidson to Andy Warhol to the United States Army. None of these are dead brands, of course, but Beanstalk’s track record with converting brand meaning into revenue is the reason Paul Earle was at the licensing expo. Beanstalk was exploring strategies to revive the Coleco and Brim brands as, essentially, licensing fodder. Michael Stone, the president and chief executive of Beanstalk, has a refined sense of the licensing business, and how consumer brands fit into it. He knows what many people think the business boils down to: I make plastic lunchboxes and you own the rights to reproduce images of Spider-Man. How about a Spider-Man lunchbox? Stone cheerfully explained to me that this is merely a “decorative” form of licensing, and that’s not his game. As a point of contrast, he told me about Beanstalk’s involvement with Stanley Works, the venerable maker of hand tools. Stanley hired Beanstalk about nine years ago. Stanley conducted “consumer permission research” to try to determine where the Stanley brand could go. “I remember looking through the focus-group tests, and there was a guy who absolutely swore that he had a Stanley ladder in his garage.” Stone paused. “Stanley never made ladders.” This is an excellent example of what “brand equity” really means in the marketplace. In contrast to the fanatical-devotion theory, part of the point of most branding is very specifically to circumvent conscious thought. Psychologists use the word “heuristics” to refer to the mental shortcuts and rules of thumb that allow us to resolve the various routine problems of everyday life without having to make a spreadsheet for every trivial decision. Brand owners want a way into your purchase heuristics. Often it is not so much a matter of, say, a Stanley Works fanatic seeking out all products bearing that trademark; it’s a matter of looking for a product and choosing one with a particular trademark that, for whatever reason, we find acceptable. This is not brand loyalty. It’s brand acquiescence. We’ve all seen the Stanley name, for instance. And by and large, we trust it. We have a general idea of Stanley that fits into our hardware-store purchase heuristics. But there is a great deal of imperfection and vagueness in these thought processes, and that is good news for a licensor. It suggests that there’s potential — or “permission” — for the Stanley name to migrate onto new products. What Beanstalk did not do when it took on Stanley as a client was recommend investing in a ladder-production facility and hiring a bunch of workers, plus a sales force to blitz potential retail channels. Stanley Works, as a company, has actually been moving in the opposite direction, closing factories and outsourcing its manufacturing since the 1980s. Instead, Beanstalk worked out a licensing deal with Werner, which was already the biggest maker and distributor of ladders in the country. “They needed another brand because they couldn’t expand the Werner brand anymore,” Stone said. So Werner started making and selling ladders with the Stanley name on them. This gave Werner a way to get more shelf space, reach more consumers and make more sales. What it gave Stanley was its name on a new product and a licensing fee. Beanstalk has worked out many such deals, hooking up the Stanley brand with manufacturers of work gloves and boots, power generators and a variety of other things that Stanley never made (and does not make now). Too many such deals, or the wrong kinds, can boomerang: this happens with some regularity in the fashion world, when a famous designer name gets spread over so many products, with so little regard to quality, that the entire image of the brand sinks. Still, if you see a ladder made by Stanley, you may well think, Well, there’s a name I can trust. What you’re trusting, though, isn’t Stanley workers in Stanley factories upholding Stanley traditions and values under the watchful eye of Stanley managers. What you’re trusting is Stanley’s recognition that a badly made ladder with the Stanley name on it could be highly damaging to the Stanley brand. You are trusting Stanley’s recognition of the value of its brand and its competence in defending that value. We circled back around to Beanstalk’s ideas for River West’s brands, particularly Brim. Stone mentioned White Cloud. White Cloud is a brand of toilet paper once owned by Procter & Gamble. P.& G. also owned the Charmin franchise, so eventually it let the trademarks on White Cloud expire. These were then acquired by an entrepreneur, who worked out a licensing deal with Wal-Mart to make White Cloud an exclusive Wal-Mart product. It became, essentially, a store brand, but infused with equity of mass-market familiarity. It’s very doubtful that the typical White Cloud buyer is aware that the product is available only at Wal-Mart. It’s also very doubtful that P.& G. (which would surely prefer that its Charmin didn’t have to compete against a brand that P.& G. itself created) will let anything like that happen again if it can possibly help it. This is essentially the situation that River West brokered with the Nuprin brand, which was a dead line of ibuprofen painkillers (once upon a time backed by the widely known “Nupe it” ad campaign). Its trademarks were acquired by River West and sold to CVS, where it is back on the shelves as a stealth store brand. (And presumably enjoying better margins than it would if, like a traditional store brand, it competed solely on low price, not trustworthy-brand familiarity.) My read was that this is what Stone thought should happen to Brim — and that Earle had mixed feelings, believing, perhaps, that Brim could come back as something bigger. Even Stone seemed at least somewhat intrigued with the possibilities of licensing a brand that was familiar but dead. “With Stanley we have to be careful — this is a famous brand; we have to do everything right and mitigate all the risks,” he says. “But with Brim, the risks. . . .” He paused. “There really are no risks.” The relationship between brands and memory (faulty or no) is a specialty of Kathy LaTour, an associate professor at the University of Nevada, Las Vegas. In one of her most interesting studies, she worked with Elizabeth Loftus, a memory specialist and now a professor at the University of California, Irvine, and a third researcher, Rhiannon Ellis, to take the issue to its logical extreme: What if, for example, an advertising campaign “implanted memories into consumers of things that never happened?” Earle says that this imperfection of memory can be used to enhance whatever new Brim he comes up with. This is “a benefit of dormancy,” he says. The brand equity has value on its own, but it can be grafted onto something newer and, perhaps, more innovative. “Consumers remember the kind of high-level essence of the brand,” he says. “They tend to forget the product specifics.” This, he figures, creates an opening: it gives the reintroduced version “permission” to forget that decaf-only limitation as well and morph into a full line of coffee varieties. “ ‘Fill it to the rim with Brim’ stands for full-flavored coffee,” Earle says, with a chuckle. “Fill it to the rim — it’s great stuff!” Finding the deceased brands that consumers are likely to remember — sort of — is a process that can begin, of all places, in the library. Earle spent hours going through old issues of People, Time, Glamour and other magazines, “looking for brand names that sounded familiar but that I hadn’t seen lately.” This results in many, many possibilities that don’t work out for one reason or another. But every so often the process yields an Underalls. Earle was intrigued with Underalls. Produced by Hanes from about 1975 to the mid-1990s, Underalls was once a prominent brand, advertised aggressively. (“O.K. America — show us your Underalls!”) It spawned “flanker” brands like Summeralls, Winteralls and Slenderalls. It was unique and memorable: a good brand. “You see the memorabilia on eBay,” Earle says. “That’s usually a good indicator.” By way of MarketTools, a research company, River West asked 1,000 women ages 25 to 54 to answer an online survey about hosiery brands. About 850 did so, and among these, 72 percent had heard of Underalls. Among those who recognized the brand, about three-quarters remembered the “Show us your Underalls” tagline. Promising. But River West needed a partner to actually manufacture and distribute whatever the new version of Underalls might be. It found that partner in Phantom, a hosiery maker based in Toronto. Phantom’s main product line is called Silks, the dominant hosiery brand in Canada. The company also manufactures a number of store brands. Phantom wanted to get into the crowded U.S. hosiery market, says Svetlana Sturgeon, vice president of sales and marketing for Phantom, and it made a certain amount of sense to leverage a name far more familiar to American consumers than Silks would be. Sturgeon jokes that, at first, she did not want to admit at meetings that she remembered the brand (“I’m much too young for that!”). But she did. The point of the original Underalls was that they combined panties and stockings into one undergarment. (“They were the pioneers in the whole idea of eliminating panty lines,” is how Sturgeon puts this.) In early brainstorming sessions, Phantom and River West tried to come up with “the most expansive but credible definition” of the brand, Earle says. In this case that turned out to be “intimate-apparel solutions,” which means anything you wear under something else that’s “functional and fashion-forward,” Sturgeon says. This includes camisoles and bras and other things the original Underalls never sold. The San Francisco design firm Thinc came up with a new graphic identity and packaging ideas that referenced classic elements of the old ads, but radically updated them. New slogan: “Lovely underneath it all.” With the prototypes complete, Sturgeon has begun the process of meeting with boutique and department-store buyers, in the hope of getting products into stores, at least on a test level, in the fall. Brand familiarity alone guarantees nothing. Sears owns several well-known brand names — Kenmore, Craftsman, DieHard, the Sears name itself — and is viewed by Wall Street as a basket case. Multinationals routinely go through cycles of acquiring and creating brands and then paring back when, inevitably, some underperform. A tiny number of hard-core loyalists not only doesn’t mean a whole lot when reviving a brand, it might be a problem because those people do remember. A number of the more cultish devotees of the VW Beetle, in fact, forthrightly rejected its reanimated version as a fraud. In that case, those consumers were marginalized by a far wider buying public who weren’t such sticklers. And really, something like the Beetle is actually a special case: it wasn’t just a well-known product, it was a cultural icon on a level that very few products or brands ever achieve. River West is trying to reanimate brands that are sort of familiar but don’t have anything like a VW level of built-in cultural capital to draw on. If there is a cult of Brim out there somewhere, it’s pretty small and very quiet. What River West really wants is to bring back these brands in a way that not only builds on their former popularity but also manages, via the skillful management of what we do remember and what we don’t, to transcend it. This would be quite a trick. A few months after he returned from the licensing expo, Earle more or less dropped the strategy of turning Brim into a glorified store brand. These days he’s talking about finding a “really innovative” coffee-manufacturing partner who could make the Brim brand an umbrella for groundbreaking (but unspecified) coffee advances that would work in the general market, not just one chain. He sounded almost protective of the Brim idea, and possibly a bit frustrated that he hadn’t hit on the way to bring it back. “Brim is, within our company, one of our best-known brands,” he said to me at one point. “In fact it’s our absolutely best-known brand. So expectations are high.” Later he added: “The strength of a dormant brand is we can remake this however we want. The challenge is we can remake this however we want.” Eventually, Earle introduced me at his office to Scott Lazar, chief executive of another River West partner, Reserve Brands, which is overseeing the revivification of Eagle Snacks. I’d never heard of the brand, but I was assured that plenty of Midwesterners knew it. Eagle had once been owned by Anheuser-Busch and was the beer maker’s way into the salty-snack market dominated by Frito-Lay. Its most well known product, it seems, was the honey-roasted peanut, particularly in tiny bags given out as snacks on airlines. Anheuser-Busch eventually pulled the plug, selling its equipment to Frito-Lay and the trademarks to Procter & Gamble in the mid-1990s. Lazar said that while the new Eagle has acquired those trademarks, the new and expanded product line consists largely of snacks that the old Eagle never made, with names like “Poppers!” and “Bursts!” These are rolling out in a variety of grocery stores across the country. Lazar tried to give me about six large bags of samples, but I demurred on account of limited luggage space. I ended up with two bags, which Earle and I took downstairs to the bar at the Ceres Cafe. It was crowded and loud, filled with big Chicago men who in some cases had spent the day screaming on the Chicago Board of Trade floor and who in all cases were not shy. We found a place to sit, plopping the Eagle snacks in front of us. And one man after another leaned into our space and pointed at the bags and boomed, “Eagle!” Big hands reached toward the bags to get a scoop of snacks that the old Eagle had never made, and at the time were not in stores, and big voices declared, “I remember those!”

Patenting Cubism, Art and Science

100th anniversary of invention of Cubism is upon us. First, Flicker Alley has just released a two-disc CD set for $29.95 titled "Discovering Cinema", which contains two French-made documentaries titled "Learning to Talk" and "Movies Dream in Color", which contain clips and full short films from the 1910/1920 time period, when people inventing the leap from silent black and white movies to color and sound, a classic problem in the history of technology evolution.

For some time, and more so in the future, many have argued that all of the arts, both methods and articles of manufacture, should be subject to the patent system, as scientists and engineers more and more apply their useful arts to the ... arts. While all artistic methods have been patentable for over 100 years (methods uncopyrightable under 17 USC 102b), it is only gradually that all artistic works are becoming patentable as the great tension between 35 USC 101's manufactures and 17 USC 102a's fixed expressions face the reality of the growing science and engineering of all forms of art. A death and an anniversary help illustrate this patenting evolution. The death is that of Lenore Tawney, who died last year in New York City at the age of 100. In 1959, the New York artist invents the genre of fiber art, by combining several techniques - plain weave, gauze weave, slit tapestry and open-warp weaving - to invent large, abstract, free-hanging sculptures from fibers. Ms. Tawney had earlier been trained as both a sculptor and a weaver, and her new genre united the worlds of arts and crafts, which had been mostly disjoint until then. A progress of the useful arts deserving of patent protection - if she had wanted to so patent - the inventor's choice. Obvious? 1959 seems a pretty late discovery date after centuries of sculpting and weaving for this to be obvious.

An important interplay of science and the arts is celebrated this year, the 100th anniversary of the invention of Cubism by Pablo Picasso, with his then infamous and now famous painting of five prostitutes, Les Demoiselles d'Avignon, one of the classic paintings in the history of all of the arts for its role in fostering modern art. It was not until one year later in 1908, that the term "cubism" was invented, when art critic Louis Vauxcelles derisively described George Braque's 1908 painting "House at L'Ebstaque" as being composed of cubes. Early Cubists were inspired by current theoies of mathematics and physics, especially the relativity of Poincare-Lorentz-Einstein, as introduced to them by mathematician Maurice Princet. The 29 September 2007 edition of New Scientist has a nice article (page 50) on this inspiration, written by Arthur Miller, emeritus professor of the history and philosophy of science at University College London. Some years ago, an excellent thesis was written on this subject. Some quotes from the article: X-rays, discovered in 1895, bolstered Picasso's belief that what you see is not always what you get. He arrived at the same conclusion after seeing the work of primitive Iberian sculptors, who represented not what they saw but what they knew. Kind of like a good patent lawyer, who drafts patent claims not on how the inventor sees the invention as is, but how the lawyer see what the invention is. And frankly and sarcastically, some patent drawings are being allowed to be so sloppy as to be Cubist :-) The painting is laid out like a motion picture in five frames of increasing geomertization: from the Egyptian-Gauginesque figure on the left, through the middle figures (fusions of French conceptual art and primitive Iberian sculpture), to the strange angles of the figure on the right, ... Now the science. Picasso's notion of viewing an object from several perspectives at once also grew out of his fascination with four-dimensional geometry. Early in 1907, he was introduced to an insurance actuary called Maurice Princet who had a keen interest in mathematics. ... In June 1907, Princet visited Picasso's studio just when the artist had become stuck on how to proceed with Les Demoiselles. .... Princet showed Picasso a book by Esprit Jouffret about complex polyhedra in four dimensions. To illustrate his results, Jouffret had projected these objects onto the two-dimensional plane of the paper in order to show them from different perspectives in succession - like walking around an object. ... Picasso was particularly struck by [mathematician] Poincare's suggestion of how to represent an object in four dimensions by projecting a succession of primitives. With a nod to Jouffret's book (inspired in part by Poincare's popular book, "Science and Hypothesis"), Poincare wrote that geometers do this playfully all the time. Why not project multiple perspectives all at once, Picasso wondered? "Obvious to try" in light of Poincare's prior art comment - an interesting example for future KSR debates? (Let's hope the question never gets to the Supreme Court, who would butcher both the art and science.) How did Picasso proceed with his reasoning? It was while viewing an exhibition of African masks that Picasso a moment of illumination. What Princet had been trying to teach him about geometry suddenly made sense .. now he understood how to add multi-dimensional geometry to the mix. The result was the face of the squatter (middle right hand side of painting), a projection from the fourth dimension, in which front and profile views are seem simultaneously, her head swivelled 180 degrees. ... [the squatter] figure underwent the most extreme transformations in hundreds of preliminary sketches [experiments]. Cubism 101-patentable as a method? Why not? Technical? Why not? Picasso created an aesthically useful application of Poincare's science. Obvious? Probably not. After all, other artists could have read Poincare's book and thought about the artistic implications. And if the genus of Cubism is patentable, why not new styles of Cubism as species as they were invented in the years that followed by other artists? With regards to "manufactures", as such species patents use narrower and narrower independent/dependent claims, when does specific expression become patent-controllable? Sadly, on the 100th anniversary of this interaction between art and science, not only are these questions unanswered, but barely asked. A painting is a manufacture. Interestingly, another scientist/artist read and was inspired by Poincare's book (Science and Hypothesis), a scientist/artist who went on to invent great things with his avant-garde thinking in the era of other avant-garde thinkers being inspired by science. His name: Einstein. As the arts become more fully subsumed into the sciences, it ends a modern evolution that started with Da Vinci, continued through Picasso and many others, and finishes in the 21st century as scientists, engineers, neuroscientists, biologists, mathematicians and othes embed the arts into the progress of science. The Founding Fathers would rejoice that we are now making the phrase "science and useful arts" redundant, that we can drop either "useful arts" or "sciences" because they now cover the same thing - everything. And with such science of art, we can embed into consumer electronics tremendous art technology that allows the entire public to more fully express their inner art visions. A goal the Founding Fathers of America, and the Founding Fathers of modern art, would allow fully support. Imagine the artistic power of Disney in the hands of all people. Is patenting movies and music weakended in any way by Comiskey? No. All forms of art - "2D" (paintings, etc.) and "3D" (sculptures, etc.) are useful (101) articles of manufacture (101) made from compositions of matter (101) that can be described by clear, decision-free sequences of instructions for either hand or machine manufacturing. The only patentability problem then reduces to 112. Which is where all these arguments below - in the 112 realm of practical instruction, not the PTO-botched and court-botched metaphysics of 101. The following claims might be surprisingly acceptable: 1) A new biological cell. 2) The useful medical uses of the cell of claim 1. why not then 3) The useful entertainment uses of the cell of claim 1. Health and entertainment are two humongous useful methods and articles of manufacture industries. Why can't I claim applications of my new science (in this case, my new cell) in both industries, especially if entertainment uses result in more profit than the medical uses? You might ask how could a new biological cell be entertaining. Come to California. The first step to make completely redundant "sciences and useful arts" was suggested by Shakespeare - throw all of the copyright lawyers into the ocean, where they can finally realize the complete lie of 17 USC 102, as the idea of drowning merges with the expression of drowning. 17 USC 102 was, is and will always be scientific nonsense, a contempt of modern set theory, a statute completely at odds with the evolutions of the arts and sciences. With copyright lawyers gone (ok, don't kill, just throw them in jail for consumer fraud), the patent lawyers can help scientists more fully embrace the arts by bringing more and more art into the form of structured patent claims.

UK rejects technical patent/Traffic light patent history

The Register (UK) has a new story about how the UK Patent Office revoked a patent for electronically processing tips on restaurant bills, ruling that the invention was "technical", WITHOUT ONCE AGAIN WHAT THE BLOODY HECK THEY MEAN BY "TECHNICAL". Maybe the UK PO should use crayons for their logical reasoning. The inventor is upset because he had spent 100,000 pounds defending the patent, and then had to sell the patent to a patent broker. Well, you are fool if you spend so much money on an such patent in the UK.
PATENT DEAL BETWEEN GE AND AFRICAN AMERICAN INVENTOR
Wired Magazine online has a brief historical inventor news item. In 1923, African American inventor Garrett Morgan gets a patent on a three-section traffic light, which so interests General Electric that they pay Morgan $40,000 for his patent (which inflation-adjusted was good money back then.) GE goes onto to monopolize the traffic signal business for awhile.

Camille Paglia, the Persona

Whenever Camille Paglia's turns out another study of the Western
Culture, she succeeds in aggravating a wide spectrum of intellectuals.

Paglia's discovery that women's reproductive powers naturally bind them to men upsets feminist intellectuals.

She says that Ayn Rand-like capitalism has freed women from bondage to men, and she makes Leftists boil with indignation.

When she associates homosexual aestheticism with some of the
most despotic systems and shows that gay men's love of all things
masculine is idolatry, she is sure to ruin their day.

She crumples the most sacred institutions of Church and State
— because it is a male attempt to smother natural female forces, the
conservatives will grumble.

Paglia's claims that the great world we call Western Culture is
nothing more than social manifestations - through literature, art,
political and religious institutions - of men's phobia of mysteries
that lurk within women's vaginas and, consequently, of women's
emotional attempts to conquer their penises. By conquering nature, men
try to counter-conquer women, sex, and everything that resists being
bottled up by intellect.

Paglia points out that the penis, unlike the vagina, is external,
hence visual; it is linear, it can be measured, compared, formulated.
The vagina, on the other hand, is ambiguous, striking in color,
impossible to quantify or architecturally simulate.

Paglia holds that nature does not conform to the laws of man, of
culture. Man sees uncontainable nature in woman, in the liquids that
flow from her genitalia during sex and menstruation, from her breasts
after childbirth, and he is threatened, even while deeply drawn to that
very object which he lacks and finds fascinating. Man turns toward the
sky, toward Greek gods, and invests his faith in transcendental logic. The
male ego is a sexual persona that replicates itself in phallic
monuments and skyscrapers, stairways to the sky, to the sun, to heaven,
in religious doctrines that designate women as the servants of men, as
shrews are to be tamed. By controlling women, men are attempting to
control nature, the ultimate representation of power. Deep down they
know that, like their own penises that shrivel into a flaccid strands
of flesh once orgasm has been achieved, their own power is fleeting.
Therefore, they fight the futile war and wreck Western Culture further
into spectacular carnage.

Paglia's language is intellectually powerful and colorful, and
together with her uncanny, perfect grasp of art history proudly
saturates the book with all things that are Paglia.
